Achieving compliance in Benin
Benin's personal data protection law governs any processing of personal data carried out in Benin, under the supervision of the Personal Data Protection Authority (APDP). Any organization that collects data about Beninese customers, employees or users is concerned, whatever its sector.
The record of processing, the starting point
As with most data protection regimes, compliance starts with a complete inventory of personal data processing: the purpose of each processing operation, the categories of data collected, the legal basis, the retention period, and any recipients (including subcontractors and technical providers).
This record is not a one-off exercise: it must reflect the processing actually in place, and be updated with each new processing operation (new tool, new integration, new partner receiving data).
Prior formalities and data subject rights
Some processing operations, particularly those involving sensitive or high-risk data, require prior formalities with the APDP before they are implemented. Data subjects also have rights (access, rectification, objection) that the organization must be able to honour within a reasonable time - which means knowing internally where a given person’s data actually is.
A framework that rarely stands alone
In practice, an organization subject to the APDP often also processes data about European residents (GDPR) or operates in a sector regulated by the PSSIE. Documenting the common technical security measures (encryption, access control, logging) once and linking them to each applicable framework avoids rebuilding a separate compliance file for each one.
